Dispute Resolution Process

Purpose

To provide a fair, transparent, and structured process for resolving disputes involving non-playing members (e.g., volunteers, staff, committee members, supporters) of Robina Raptors in a respectful and efficient manner.

1. Informal Discussion

• The parties involved in the dispute should first attempt to resolve the issue amicably by sitting down together in a neutral setting.
• If needed, a mutually agreed-upon mediator (e.g., a club official, senior volunteer) may facilitate the discussion.
• The goal is to reach a resolution through open communication and mutual understanding.

2. Formal Mediation (If Required)

• If the dispute remains unresolved after informal discussions, either party may request formal mediation.
• The club will appoint an independent mediator (e.g., a neutral committee member or external mediator if necessary).
• Both parties will present their perspectives, and the mediator will assist in finding a fair resolution.
• A written record of the agreed outcome will be kept by the club.

3. Escalation to Disciplinary Subcommittee

• If mediation fails, the matter can be escalated to the club’s Disciplinary Subcommittee in writing.
• The subcommittee will review the case, including any evidence or statements from involved parties.
• A hearing may be conducted where both sides can present their case.
• The subcommittee will then make a final, binding decision, which may include:
  • A formal warning
  • Suspension of club privileges
  • Termination of membership (if applicable)
  • Other appropriate sanctions

4. Final Note

• All parties are expected to engage in good faith throughout the process.
• Retaliation against any individual for raising a dispute will not be tolerated.
• Confidentiality will be maintained where possible to protect all involved.

5. Review

This by-law shall be reviewed annually by the Executive Committee to ensure its continued relevance and effectiveness. Any changes to this by-law shall be communicated to all members in a timely manner.

6. Adoption

This by-law shall come into effect from December 1, 2024, and will be reviewed in 12 months.
